1. GENERAL PROVISIONS.

1.1. We encourage you to review this Privacy Policy whenever you access the Services to make sure that you understand our information collection, use and disclosure practices.

1.2. We may update this Privacy Policy from time-to-time to keep it in conformity with the relevant legislation and will indicate when changes have been made by revising the date at the top of the Privacy Policy. We will keep you informed about the changes to our Privacy Policy. If we make any major changes to our Privacy Policy and will need your explicit consent for further processing of your Personal Data, we will request your consent or your renewed consent (in case it was obtained previously).

1.3. OUR APP IS DESIGNED AND DEVELOPED FOR PARENTS TO USE WITH THEIR CHILDREN. WE ONLY PROCESS CHILDREN DATA WITH VERIFIED PARENTAL CONSENT. HOW AND WHAT PERSONAL DATA OF CHILDREN IS PROCESSED IS SET FORTH IN THIS PRIVACY POLICY.


2. HOW DO WE COLLECT YOUR PERSONAL DATA?

2.1. We collect Personal Data if you provide it to us or automatically by electronic means. If you contact us in messengers or social networks, we may also collect information about you available on such messenger or social network.


3. HOW DO WE PROCESS YOUR PERSONAL DATA?

4.1. We can share your Personal Data (except for Children Data) with third parties only in the cases listed below:

4.1.1. When we are required by law: We may disclose your Personal Data to the extent that we are required to do so by law (which may include to government bodies and law enforcement agencies), in connection with any legal proceedings or prospective legal proceedings and in order to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention).

5. HOW LONG DO WE RETAIN YOUR PERSONAL DATA?

5.1. We retain your Personal Data for no longer than it is necessary to fulfill the purposes specified in the Section “How do we process your Personal Data”. Except for any legal obligation that sets a longer data retention period, at the end of these periods, the Personal Data processed will be deleted or anonymized.


6. DO WE USE AUTOMATED DECISION-MAKING OR REFER TO THE AUTOMATED PROFILING?

6.1. We neither use automated decision-making nor refer to automated profiling.


7. WHAT RIGHTS DO YOU HAVE?

7.1. Rights of EU residents:

  • The right of access to your Personal Data meaning that you can receive a copy of the Personal Data that we hold about you, as well as other supplementary information.
  • The right to rectification of your Personal Data which is incomplete or inaccurate.
  • The right to erasure of your Personal Data meaning that you can ask us to delete or remove your Personal Data in certain circumstances. Note, that we can retain your Personal Data as necessary to comply with our legal obligations or resolve disputes. If we have no grounds to continue processing your Personal Data, we will delete or remove it and notify you about such deletion or removal.
  • The right to restrict processing of your Personal Data if (a) the accuracy of the Personal Data is contested by you, (b) the processing is unlawful and you oppose the erasure of the Personal Data, (c) we no longer need the Personal Data for the purposes of the processing, but they are required by you for the establishment, exercise or defense of legal claims, and (d) you have objected to processing pending the verification whether the legitimate grounds override this.
  • The right to data portability. The right to portability of your Personal Data, which applies only to information we have processed based on your consent or Terms of Use.
  • The right to object to the processing of your Personal Data where we are relying on a legitimate interest and there is something about your particular situation that makes you want to object to the processing on this ground. We will no longer process the Personal Data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.
  • The right to withdraw consent at any time where we are relying on the consent to process your Personal Data. If we have no other grounds for processing your Personal Data, after you send us a request to withdraw consent, we will stop processing your Personal Data that we were processing under your consent.

7.2. We will address your request as early as possible and no longer that within 1 (one) month. Please note that this period may be extended by 2 (two) further months where necessary, taking into account the complexity and number of the requests. In this case, we will inform you of the extension within 1 (one) month of receipt of your request and will explain to you the reasons for the delay.

7.3. Rights of California residents:

  • The right to opt out. Under the CCPA each California resident can request business stops selling Personal Data to third parties.

Do we actually “sell” Personal Data? We do not, and will not, provide your Personal Data in direct exchange for money. Therefore, in the literal sense, we do not sell your Personal Data.

  • Other rights. You also have a right to be informed about what categories of Personal Data we are collecting: you can request us to disclose what Personal Data we have collected in the past 12 (twelve) months and right to get a free copy of your Personal Data disclosed in a readily usable and readable format. You can also request us to delete the Personal Data we have collected in the past 12 (twelve) months. We will not discriminate against you for exercising any of your rights granted under CCPA.

7.4. Mandatory Verification: As required by CCPA we will need to verify your identity before processing your request. In order to verify your identity, you will be asked to log in to your account or (if you do not have an account) we will try to match the information you provided with the information we handle about you. In certain circumstances, we may decline the request, mainly where we are unable to verify your identity, for example, if you have requested us to delete your Personal Data.

As required by CCPA we endeavor to respond to a verifiable request within 45 (forty-five) days of its receipt. If we require more time (up to 90 (ninety) days), we will inform you of the reason and extension period in writing. We will deliver our written response by e-mail.

7.5. How to exercise any of your rights?

7.5.1. Part of the rights related to the processing of your Personal Data in our App, you can implement in the settings of your profile in the Application, or

7.5.2. You may exercise your rights by sending a relevant request to the e-mail indicated in the contact details. If you have any comments about how we process your Personal Data, please let us know and we will consider your claim. If you are not satisfied with our response to the complaint, you have the right to file a complaint with the competent authority.

7.6. In addition to the rights set forth in this Section 7, parents also have the rights set forth in Section 8 of this Privacy Policy which we kindly ask you to read it.


8. CHILDREN DATA.

8.1. General provisions.

8.1.1. We are committed to protecting the privacy of children who use the App.

8.1.2. This Section 8 of the Privacy Policy explains our information collection, disclosure, and parental consent practices with respect to information about the children.

8.1.3. The App is intended for parents to use with their children. Children under 13 (in the US) and children under 16 (in the EU) may only use the App, if we have obtained verifiable advance parent or guardian consent.


8.2. Registration and parental consent.

8.2.1. We comply with the COPPA, CCPA and GDPR, which among other things requires that we obtain verifiable parental consent before we collect Children Data who are under 13 (in the US) and 16 (in the EU). Therefore, we only collect Personal Data through the App from a child under 13 (in the US) and 16 (in the EU) where that child’s parent or authorized legal guardian has expressly agreed that their сhild may use the specifically tailored, age-appropriate App.

8.2.2. PLEASE BE NOTED THAT CHILDREN ARE NOT PERMITTED TO REGISTER WITH OUR APP AND TO CREATE AN ACCOUNT BY THEMSELVES. WE DO NOT COLLECT ANY PERSONAL DATA FROM THE CHILDREN. ONLY PARENTS ARE ALLOWED TO CREATE AN ACCOUNT IN THEIR OWN NAME. PARENTS WHO HAVE DOWNLOADED AND BOUGHT A SUBSCRIPTION TO THE APP AND CREATED AN ACCOUNT HAVE THE RIGHT TO ALLOW THEIR CHILD TO USE OUR APP.

8.2.3. Through the App we may collect only Children Data (defined above). WE DO NOT COLLECT LOCATION DATA, MICROPHONE AND CAMERA SENSOR DATA, OR ANY OTHER PERSONAL DATA RELATED TO YOUR CHILD THAT IS NOT MENTIONED IN THIS PRIVACY POLICY.

8.2.4. If you are a person under 13 (in the US) and under 16 (in the EU), please do not send any Personal Data to us if your parent or guardian has not expressly consented. Also, please do not send any Personal Data other than what we request from you in connection with usage of the App. If you are a parent or legal guardian and believe that your child has provided his or her Personal Data without your consent, please contact us support@taskiehusky.com. If we learn that a person under 13 (in the US) and under 16 (in the EU) has provided us with Personal Data beyond what we request from him or her, we will delete that information as quickly as possible.

8.3. Transferring of the Children Data

8.3.1. We do not transfer the Children Data to any third party unless it’s required for the business to operate App. Nevertheless, we may share or disclose Children Data if permitted or required by law.

8.3.2. To the extent permitted by applicable law, we also may disclose Children Data:

  • in response to a law enforcement request;
  • if we believe disclosure may prevent the instigation of a crime, facilitate an investigation related to public safety or protect the safety of a child using our App;
  • to enable us to take precautions against liability.

8.4. Parental choices and rights.

8.5. At any time, parents can refuse to permit us to process Children Data in association with a particular parent’s App account, and can request that we delete from our records the Personal Data we have collected in connection with that account. PLEASE KEEP IN MIND THAT A REQUEST TO DELETE RECORDS MAY LEAD TO A TERMINATION OF AN ACCOUNT AND / OR SUBSCRIPTION.

8.6. Parents can contact us to request access to, change, or delete their Children Data by sending an email to us at support@taskiehusky.com. A valid request to delete Children Data will be accommodated as soon as possible, but not later than within one month.


9. COOKIES POLICY.
